Denied BP Claims Flowing from the GCCF

Denied BP Claims hitting an All Time High

BP Claims

BP Claims Get Denied

If your BP Claims were recently denied you were not alone, we are seeing well documented, well organized BP Claims getting denied at the GCCF at a record rate. It seems that the GCCF is clearing out all of the BP Claims that it has been holding on to.

We can Help You if you have been denied.

At this point there will be very few claims left with the GCCF before the Fund transitions into the BP Settlement process. The Denial rate is utterly astounding, we have NEVER seen this rate of denied BP Claims come out of the GCCF since it`s inception.

Are BP Claims being forced into the Settlement Process

When you step back and look at the strategies displayed by the GCCF, you just can`t help but think that they are just making way for the upcoming BP Settlement. This is part of the Delay, Deny, and Defend tactics, and is meant to dishearten the people from pursuing their BP Claims.

They are just trying to wear down people with legitimate BP Claims. As we have told you before, this is a common tactic that has been used through out the BP Claims Process, this strategy was originated by unscrupulous insurance companies. The GCCF is making one last effort to thwart paying legitimate BP Claims, even while in transition.

Look for all of the present employees at the GCCF to be replaced in the very near future.

Do not let them make you loose heart for your economic justice. We can and will Help You.

BP Claims and the BP Settlement

We are hearing from a large number of you that are concerned that there will not be a major shift in attitude from the GCCF to the new BP Claims Settlement Fund. As I see it there will be a DRAMATIC shift and it will be coming from the top down. As I said above they are getting ready to get rid of all GCCF employees as the new regime is about to take charge, and it couldn`t be happening soon enough for many of us. Judge Barbier is running the show with Patrick Juneau, and everything I have heard about Mr. Juneau, and much of this from people that know him, all say the same thing, stand up, no nonsense guy, with a an over all concern for people. Let`s hope that carries through. Time will tell. If you would like to connect with Attorneys or Adjusters that can help you with your BP Claims for the settlement, please fill out the form to the right.

BP Claims and our Stance

We at BPClaims.org have only had one goal in mind since this all began, to help people. We started with sites that got people to charities, and that morphed into following the BP Claims process, The BP Claims process under Feinberg and the GCCF was AWFUL, people were duped into Quick Pays when they were promised Interim payments, many took these and agreed not sue BP, and are now struggling once again with no remedies in site. We will continue to fight for these people, and will continue to organize them.

We will continue to help individuals and businesses that were denied, we are actively helping people with medical claims. When nobody wanted to take these cases we found a group that would, and I am happy to say that same Firm helped get them into the BP Claims Settlement, and they are now going to be compensated.

If you need help with Your BP Claims even if they were denied, we can and will help you, Consultants and Adjusters start at 15%, Attorneys start at 20%, Large Loss Business Claims can be handled for 7.5%.

We are not allied with any particular Firm or group, but simply will get your claims to the best possible Group that specializes in those particular claims.

We will Help you with your BP Claims.

BP Claims and the BP Settlement

The BP Settlement and your BP Claims

BP Settlement and BP Claims

Everything that needs to happen before the BP Settlement can take place is happening, there are a few things that have needed to transpire in order for the settlement to take place, and it looks like they are. It looks like more of a reality each day, news has leaked that they are developing a matrix to help calculate BP Claims for your final BP Settlement. Ken Feinberg`s days look numbered.

The Restore Act is getting closer to passing, the Gulf States would then receive approximately 80% of the money from the settlement. Everyone agrees this must be done before the BP Settlement.

BP is still cutting deals with partners, and the people in the know, say they know. The fact is we will see. Though at this time I don`t think it is a good idea to take any final BP Claims payouts, we are just too close to the trial date, and the high likelihood of a BP Settlement.

Denied BP Claims and BP Claims with Offers

If your BP Claims were denied, been made offers, or or have languished at the GCCF, now is the time to act. Get your claims information together and get it to one of our BPClaims.org accredited Consultants, or one of the Law Firms that we have connected with that have proven track records. They will only charge you on the New money they get for you. We have been in this process for a long time now, and we know who talks the talk, and walks the walk. I think we all have had enough of those who talk.
Our network extends from Houston to Key West, and they all know how to get people paid. The new BP Claims matrix will be in place soon and it looks something like this.

The matrix will have different Industry categories to it, with different payouts per geographical area.

Here is an example.
A Fishermen in Louisiana will get 4 x their 2010 loss, while one in the Florida Keys will get 2 x their 2010 loss.
A Waiter in New Orleans will get 3 x their 2010 loss while a Waiter in Fort Meyers will get 2 x their 2010 loss.
A Marina in Mississippi will get 4 x their 2010 loss while a Marina in Tampa will get 2 x their 2010 loss.
These are just examples, we don`t know the matrix yet, but aspects have been leaked.

It looks like the end for Mr.Feinberg and his role in the BP Claims Process

Mr. Feinberg, you have on the whole failed, you starved out people, and gave them Quick Pays, people lost their houses, their cars, and their families as they waited, and waited, and waited, whole towns were destroyed as you laid in bed with BP. Generations of livelihoods were crushed. You told us in the beginning that you were independent, when you took over the process on November 23rd, 2010, many people had high hopes for you, you promised much, but delivered little, you saved BP a lot of money, you got a raise while others starved. In the end Judge Barbier had to stop you from telling folks you were independent. You created a complex GCCF Methodology that was cloaked in secrecy, and people with master degrees couldn`t decipher. Thank God our people did. Transparency of the BP Claims process was what you promised, but instead did the exact opposite. An audit had to be performed. You made promises Sir, you made lots of promises most of them left un-kept. In the end your legacy will be tainted with oil, it really is a shame, we all wanted you to be for the people, and to help save our ways of life, when in fact all you did was save BP money.

We will help You with your BP Claims and your BP Settlements, Consultants start at 15% and Attorneys at 25%, and they only get paid when they recover your BP Claims money.

Denied/Delayed BP Claims

BP Claims

The Top 7 Reasons why BP Claims get Denied or Delayed

Most of these are curable and shouldn`t have happened if prepared properly.

7. Category Denial. Being an Oil Rig Worker/Oil Spill Clean Up Worker/government employee

6. Deficiency Denial. Failing to provide needed information within the 30 day expiration period.

5. Deficiency Denial. Failing to provide income data and not submitting evidence before the 30 day expiration to cure the deficiency.

4. Deficiency Denial. Failing to provide evidence of employment/business at the time of the Spill.

3. Trending Failure. The business demonstrated a Post-Spill economic gain.

2. Reviewer Error. An error is made by the reviewer while processing. This often happens if the claims is not formatted in an understandable manner.

And the number 1 reason for denial of GCCF claims……

1. CAUSATION, CAUSATION, CAUSATION.

All of these reasons are valid for getting your BP Claims Denied. For the most part they are also curable. This is why we have assembled a Team of BP Claims Experts to help you with your BP Claims. Some BP Claims are best handled by Consultants and Adjusters that can cure deficiencies with your GCCF Denied Claims, while in other instances you may need an Attorney to help you get through causation or category issues. As the BP Claims process has evolved so have we, we will continue to evolve as needed. Whether it is a consultant or an Attorney or a combination of both, we will help you with your BP Claims.

BP Claims in the News

The GCCF has been in the news lately, it has shown it`s contempt for accountability and the transparency that it once promised. Jim Hood The Attorney General from Mississippi is holding their feet to the fire, and just won a legal victory by getting the Hearings for his audit moved to the State Court of Mississippi. He has been trying since February to audit the Mississippi BP Claims, Ken Feinberg made promises of transparency, but is hiding behind legal wrangling, trying to delay the inevitable. Promises were made, and promises continue to be broken by Ken Feinberg and the GCCF.

How we Handle your BP Claims.

When you fill out a free case review for your BP Claims, we put that information in the hands of the best Team member that can best facilitate your claim getting paid.

We are not aligned with one particular Law Firm or Consultant/Adjuster s firm. We simply want your claim handled by the best group for your particular case.

Think about it this way, do you want the same firm that is handling your business claim, also handling your medical claim, probably not.

Some of our Team members are Large Loss Experts, and have gotten millions in BP Claims paid, others specialize in BP Restaurant Claims , while others specialize with Causation issues, Denied BP Claims, and claims Stalled at the GCCF. Team members range from Claims Consultants and Adjusters to Attorneys that have been up against BP before, and won the largest awards that BP has ever had to pay out. The results have been impressive, lately we are getting BP Claims paid that are organized and calculated properly in record time.

Claims preparation and presentation to the GCCF starts at just 15%, if an Attorney is needed representation starts at just 25%. All fees are paid on a contingency basis, they don`t get paid until you do.

BP Claims Breaking News

Denied BP Claims are still on the Rise

BP Claims

BP Claims

The Gulf Coast Claims Facility has shown no mercy for incomplete BP Claims. Many of the claims are not incomplete but simply mislabeled.
This has led many to believe that the GCCF is intentionally misleading people and business’ filing claims. The fact is the GCCF has told attorneys that they can file claims that are not complete. Though a few offers have been made, many are still facing deficiency and denial issues. This is an overt act on the GCCF`s part to confuse an already difficult process. Make sure when you are asked for BP Claims documents that you furnish all of the ones the attorneys or BP Claims adjusters ask for.

BP Claims Audit on Track

Perhaps the biggest news is about the audit. The U.S. Senate voted Tuesday to move forward with the GCCF audit. The proposal was spearheaded by Marco Rubio and Roger Wicker and was passed as an amendment to a package of spending bills. It should be noted that Jo Bonner and Jim Hood have been tackling this issue for some time. This would insure a review of the process that the Gulf Coast Claims Facility uses to evaluate and pay out claims of economic damage resulting from the oil spill. Hopefully this will get to the bottom of something that should have had more government oversight for some time.

Moratorium BP Claims back on the Table?

Ken Feinberg is making statements that he wants BP to pay for the workers and businesses affected by the moratorium. This is an expected move from Feinberg. As he comes under fire from other areas, he usually tries to offset the scrutiny by doing something positive. He said he needs BP`s permission to do this. It would bode well for him if he could get their cooperation on this issue. The only reason drilling was shut down was because of BP`s shortcuts. Giving people back what the moratorium stole from the people and businesses would only be fair. Moratorium Claims should be paid.

The Seafood Industry and BP Claims

BP Claims

BP Claims and Seafood

Lets face the truth here, the news it not good on most fronts. The FDA admits the majority of Shrimp show signs of contamination, and the catches of shrimp are down dramatically. Crab catches are down 30-40%. There seems to be signs of some brown matter in most of them, visible since their shells are transparent in the young. For this and other reasons, scientists on the front lines with one of the largest crab wholesalers say it will take 7 years for the crabs to rebound. To top it off pregnant women and children are being advised not to eat Gulf Shrimp. By the way the PAH`s in the Gulf Shrimp bio-accumulate and move up the food chain as they are eaten by predators. In the end we are at the top of that food chain. Feinberg promised to help Shrimpers  Claims after getting grilled on Capitol Hill.

BP Claims Unsolicited 25k Offers

ffff

BP Claims receive Unsolicited Offers

BP Claims

The GCCF is making unsolicited offers for your BP Claims. As it turns out they are calling people with valid BP Claims, and offering them BP Claims Quick pays in many instances. Many of these people are business owners who lost more then the 25k they are being offered for their Oil Spill Claims. If you receive any of these offers, and want to speak to an expert regarding your Gulf Coast Claims, we can help you get straight answers regarding your BP Claims.

BP Claims Experts

All BP Claims experts are not the same, there are law firms, accounting groups, claims adjusters, all trying to get a piece of the Oil Spill Claims pie. I am proud to say that hands down we have put together the best people in the country to handle your Oil Spill Claims. They are known in the Industry, and yes their is now an Industry around the BP Claims process, as the preeminent experts in their respective fields. We have a BP Claims Calculations expert, we have a BP Claims litigation expert, and a firm specializing in people that have gotten ill during the oil spill. The Claims Team that we have assembled is truly at the apex of their respective fields. Remember that all members of the BP Claims Team are separate entities, but many of them are now collaborating together to get your BP Claims paid.

BP Claims Paperwork

When you are preparing for the BP Claims process have your tax records, w-2`s, and bank records ready for 2008, 2009, 2010. If you are a business, have a P and L ready for 2009 and 2010, they are now asking for 2011. Get all the paperwork together you can to substantiate your loss. If you were layed off as a result of the BP oil spill, as the financial effects trickled down through the economies, get a letter from your boss. If you are a business that lost a contract due to the oil spill, ask for a letter from the client who had to cancel the contract. Do not overburden the GCCF or people handling your Gulf Coast Claims with extra un-needed paperwork. It slows down the process and allows for more error, we are very well aware of the fact that the GCCF mislabels paperwork in your file, less documentation can be a benefit, overwhelming the process with lots of irrelevant paperwork will not help your BP Claims.

Our BP Claims Solutions

BP Claims at the GCCF

If your BP Claims are filed with the GCCF and you are tired of waiting for the decision, or have received deficiency letters and would like your claims troubleshooted and recalculated members of the Team can do that for a 15% fee of what is recovered. BP Claims Adjusters are best utilized here.

Denied BP Claims

If your Oil SpillClaims have been denied there are a number of options available. Members of the Team can reorganize and recalculate your claims all while it is sitting at the GCCF. People who have tried to handle their claims themselves and been denied 3 times have utilized members of our Team, and gotten their claims approved, one within 9 days, though that is not the norm, it usually takes about 45 days. If your Claims have other issues such as causation, moratorium, or other legal challenges it maybe best to speak with one of our noted Claims Attorneys. Claims Adjusters, and or Attorneys should be considered here.

GCCF makes you a BP Claims Settlement Offer

If the GCCF makes you an offer on your Oil Spill Claims, our  Claims Experts will review the settlement at no charge and tell you if you should receive more. They will only charge you for the extra monies you receive above the original offer. BP Claims Adjusters are best utilized here.

Your BP Claims lack paperwork or has other Issues

In some cases, where there is a lack of necessary documentation or other issues are at hand, it may be best to place your BP Oil Spill Claims with an Attorney. An Attorney specializing in the BP Claims process has several different tools at their disposal in-order to help you get your BP Claims settled. They may choose to litigate your Oil Spill Claims, they may put your BP Claims in a pool of other similar Oil Spill Claims, they may directly negotiate with GCCF on your behalf, all in-order to get your BP Claims paid. BP Claims Attorneys are best utilized here.

BP Claims that have not been filed yet

If you think you can handle your Oil Spill Claims by yourself, and want to give it a try by all means do. Do not let the GCCF tell you how to calculate your BP Claims though. If you think that you have a grasp on all the necessary calculations and their ever changing trending( this is why most BP Claims are denied), my hat is off to you. If you want the help of Claims Experts that have been there, done that, and are the most respected BP Claims Experts in the country, you may want to consider using a Claims Adjuster or a BP Claims Attorney.

How much does it cost to handle your BP Claims

All BP Claims professionals that we work with, work on a contingency basis, they don`t get paid until you do. BP Claims Adjusters and Consultants charge 15%, and BP Claims Attorney`s that handle a myriad of oil spill claims and legal issues charge from 20%-33 1/3% to handle your BP Claims.

25k BP Claims Quick Pay is No Gift

BP Claims Quick Pay touted by the GCCF as a Gift

BP Claims Quick Pays

According to our BP Claims Experts more then 50% of the BP Claims Quick Pays calculate out to be substantially higher then the 25k settlement offer. It doesn`t matter if your losses are 50k or 500k and supported by BP Claims documentation. I can`t tell you how many people I have spoken to that regret taking the BP Claims Quick Pays. The GCCF is surging ahead these days making BP Claims Quick Pay offers to business`s owners in mass. Often they will tell you, you don`t have all your paperwork together, or your oil spill claim is deficient in some way. Often the GCCF will deny your BP Claims only to circle back to you, and offer you the Quick Pay, making it seem like a gift. Let me assure you, the GCCF BP Claims Quick Pay is not a gift.

BP Claims Audit is on it`s way

The GCCF is not handling the BP Claims process fairly and people know it. The Attorney General from Mississippi (Jim Hood) and the Attorney General (Eric Holder) for the United States is taking them to court to audit the BP Claims process. Mr. Hood tried to get the information from the GCCF but they kept stalling him, sound familiar. In a last resort two of the top Attorneys charged with protecting the Rights of the People are gearing up to do battle for the People. If BP and the GCCF were handling the BP Claims process correctly, this would not be necessary.

BP Claims Quick Pays may get a second chance

A group of Attorneys have filed papers with Judge Barbier in New Orleans asking that the Judge review the Quick Pay system, because they charge that they are illegal under OPA. They further charged that BP Claims Quick Pays were offered to people that were under duress, and forced to take the BP Claims Quick Pays. If the Judge rules in favor of the Attorneys it could mean that people and business owners that accepted the Quick Pays could get a second chance to get what they deserve from the BP Claims Process.

What to do about your BP Claims and Quick Pays

First don`t let them pressure you into accepting the BP Claims Quick Pay, understand that this is part of their strategy to buy you out of suing BP for future damages. You need to get a second opinion on your BP Claims settlement offer from the GCCF, whether it is a Quick Pay or a Final Settlement. We have teamed up with several groups  that will review your Claims Settlements at no charge, and if you have been offered a Quick Pay of 25k, they will only charge you for any any recovery above the 25k. There really are people out there that will help you with your BP Claims. Fees start at 15%, fill out the form to the right and start getting help with your BP Claims. Our Experts can also look at your oil spill claims while they are still a the  GCCF, if they are Under Review or have been Denied, there is help for your BP Claims.

BP Claims New Tactic Deployed

GCCF`s New BP Claims Delay Tactic

BP Delays Claims Again

The GCCF`s new tactic to delay your BP Claims is called the Deficiency Notice. After speaking with 4 business owners last night, they ALL had just gotten deficiency notices for their BP Claims. The Business Owners had already provided the documents that the deficiency notice said were missing from their files. The documents were never missing from their files, but the GCCF said they were, and they could not process their  BP Claims. Again their BP Claims were delayed.

BP Claims Mislabeled

One of the individuals who owns a good size business decided to go down to his local GCCF office and talked to them directly about his BP Claims. He had spoken to this person before and she went through his file with him standing right there. After going through the file they found the documents the GCCF said were deficient. The documents were there, they were just mislabeled. His BP Claim was then sent to a Claims Review Specialist. The new Claims Review Specialist has given his claim a new number, and can now look up all the pages in his BP Claims to finally make a determination on his claim. He was told that he would have an answer shortly regarding his BP Claims.

BP Claims Pattern

After making four phone calls yesterday to follow up with people, they all had the same exact story about their BP Claims. Coincidence, I don`t think so. The GCCF is pulling out every tactic it can to delay your BP Claims. Mislabeling documents that have already been sent in might happen once in awhile by careless processor, but not four follow up  phone calls in a row. Has the GCCF  mislabeled BP Claims documents intentionally, only to buy more time and frustrate the people in the BP Claims process, I think so. This is just one more road block that the GCCF is using to frustrate and delay people from receiving their BP Claims money, and hoping they go away.

Getting your BP Claims Paid

BP Claims and how to get Paid

Getting Your BP Claims Paid

You can make BP claims with the Gulf Coast Claims Facility created by BP and Ken Feinberg, who promised to ” Make it Right.” They also said your BP Claim would be handled within 90 days after the Emergency Claims deadline of November 23, 2010, but many who filed right after the deadline are still waiting. It is mid-June now and individuals and businesses have been waiting 9 months for their BP Claims money, only to hear we need more documents or their case is under review. Even worse, many people waiting for their BP Claims money, were told they were denied or simply offered the 5k quick pay for individuals or the 25k quick pay for businesses as long as they agreed not sue BP.

The best results I have seen for people going through the BP Claims process has been to hire a BP Claims Attorney. Instead of the GCCF being able to use bullying tactics, good oil spill attorneys will handle them for you. Instead of being offered for 1- 2 years of losses from BP, which I still have not heard of happening, oil spill attorneys will ask for 3-5 years of losses and handle negotiations for your BP Claims money for you. They will also push for interim payments so that you have some time to evaluate the true impact of the oil spill on you or your business.  Many interim claims payments have been accompanied by final settlement offers. It is up to you to accept or reject your final BP claims settlement.

If your BP claim was denied, it may be a blessing in disguise, as you probably have all of your paperwork available, and when you give it to an Attorney they may be able to point out that you should have filed multiple BP Claims, or other things you may have overlooked. Having all your documents in order will certainly expedite your BP Claims.

BP Claims: How Long does it Take

If you are still waiting for the GCCF to “Make it Right,” your BP Claims money may have to wait until February of 2012 when the litigation is scheduled to begin.  They may make an offer between now and then, but I would not bet on it unless it is a quick pay, or a low ball final settlement. Now mind you the GCCF could have a change of heart between now and then, and become immensely fair and truly try to make it right, but again I wouldn`t bet on it; it just doesn`t fit the present corporate culture when it comes to handling BP Claims.

BP Claims Attorneys that we have connected with have gotten their BP claims paid within 2 months recently. These attorneys know how to deal with the GCCF and they know how to organize your BP Claims and maximize your BP Claims. They are also quick to point out that you and your family or business may have multiple BP Claims. There is also an accelerated BP Claims process that I have been recently told about that helps large employers avoid laying off employees. Though there is no set time table to get your BP Claims paid, it does seem attorneys get them done much faster.

BP Claims: The Trickle Down Effect

If large segments of a community lose the ability to work, it’s natural that they stop spending money for other things.  If they had received BP Claims money from the beginning it would have encouraged spending in those areas. Instead, businesses and the employees that work in those businesses bore a large brunt of the economic hardship and often the BP Claims process tries to overlook them. Beauty parlors, lawn services, general contractors, restaurants, many in the service areas of the Gulf economy were severely impacted by the Gulf Oil Spill. Any non-essential business was hit hard when people stopped spending in the Gulf Region, though BP has made it difficult for many in these businesses to file BP Claims, often citing that there is no correlation between the spill and the economic downturn, though we all know differently. The Oil Spill did have a direct economic impact for many and they should be compensated through the BP Claims process.

BP wants to Dismiss BP Claims

BP Attempts to Derail the BP Claims Process

“BP’s position is not that every single claim needs to be dismissed,” Andrew Langan, BP’s lawyer, told U.S. District Judge Carl Barbier at today’s hearing. Claims that have been improperly filed or not yet presented to BP’s trust fund should be dismissed, he said.

So in essence BP does not want to pay your BP Claim if you made a mistake on your BP Claim or  if you haven`t filed one yet. Unless I am reading this way out of context, and I don`t think I am, BP is trying to mitigate it`s damages and block people from becoming part of the BP Claims process, if they have not already received your BP Claim, or they made a mistake filling it out. The truth is more then 70% of those eligible still have not filed their BP Claims.

Report Blames Obama, BP Claims not getting paid

The committee, chaired by Darrell Issa, said: “Many believe BP is not meeting its obligations and the federal government has abdicated its responsibility to intervene. The report also strongly criticized Barack Obama’s administration for failing to take charge of the clean-up and compensation, slamming the President for placing “the perpetrator of a reckless and unnecessary tragedy at the helm of the recovery operations”. The BP Claims Process has created the following according to the report “excessive compensation delays, inconsistent judgments, requirements that victims relinquish further claims against BP as a condition of compensation, and efforts to dissuade victims from obtaining legal representation.”

The report cited several glaring examples of the lack of consistency in the BP Claims Process. perhaps the most glaring was two fishermen in the Lafourche Parish who filled out very similar claims and had similar incomes, but one received $100,000 more. We have heard even worse BP Claims inconsistencies, for example we have often heard of two waiters or waitresses at the same restaurant, making the same money, putting in identical claims, only to have one claim accepted and another rejected. The BP claims process has been anything but fair.

BP Claims and You

I urge you to look at your income from previous years compared to 2010 and 2011, I urge you to look at the value of your Business, if you notice a drop, and it is in anyway connected to the Oil Spill, I strongly urge you to file a BP Claim. If you lost revenue, and it is Oil Spill related you are entitled to file a BP Claim. Personally I believe the whole Gulf Region was shutdown during the whole spill, and people immediately stopped spending. Some areas are rebounding faster then others, but what does the future hold?

BP set aside 20 Billion dollars to settle the BP Claims. According to recent articles, BP thinks it can get them all settled for less then 5 Billion, last month they thought they could have everything settled for less then 10 Billion, in essence BP just saved 5 Billion Dollars in one month, and do you know whose pocket that 5 Billion Dollars came from, it came from YOURS. BP is trying to shirk their responsibility to pay BP Claims, just listen to their own lawyers.

So if you want Help, we have connected with what I feel are some of the Best Attorneys in the country to handle your BP Claims, they can tell you if you have a BP Claim, and that is Free.
