bp settlementWith Judge Barbier`s final approval of the BP Settlement, combined with finally seeing a sample set of all types of claims get paid or receive offers, we more fully understand how different types of claims, in different zones will be treated.

Should we have had this understanding before the opt out date, sure, but we have to play the cards we have been dealt.

DeepWater Horizon Settlement Incomplete Claims

What many people and businesses are experiencing are Incomplete Notices, for many, these come one, after another, after another, after another, you get the idea.

Old GCCF Claims

When the GCCF Closed it`s doors they had almost 1 Million Claims that they were processing, what happened to all of these claims, well for the most part, people and businesses did not update them for the BP Settlement.

The last update that I read from the DeepWater Horizon Settlement, they had approximately 91,000 people and business that had filed with the Settlement.

Within the Judges order he said they anticipated over 1 Million claims to apply for restitution.

BP Settlement Gets Judges Approval

Judge Barbier Approves the BP Settlement

deepwater horizon settlement  If you follow the doomsday theorists, 12/21/12 was suppose to be the end of the world, well, not really, it was the first day of the official BP Settlement. Any connection, probably not, but Judge Barbier did lay a compelling and substantive case as to why The DeepWater Horizon Settlement should move forward. You can read it for yourself here.

There are issues with the settlement, but the fact of the matter is we all just want to see people and businesses get paid, and this is what we have to work with. There was a lot of interesting information in the 125 page document. Most compelling was the Judges rebuttals of the numerous objections raised. The Judge provided his thoughts in great detail as to why he thought certain objections did not have merit, or were basically outweighed for numerous reasons, citing a variety of case law.

I still believe there are issues with the Customer Mix Test and NAICS codes, but much of that can be handled with an Appeal, and we will all see how those Appeals are handled. If David Duval who heads up the BP Settlements Appeals division can get adequate compensation for the BP Settlement Claims that deserve it, and if he is given some latitude in correcting NAICS codes and other assorted anomalies, then I think the BP Settlement is a strong substitute for litigation. We will see how this aspect of the process unfolds, and how much leeway he and his Team are given. There is a lot riding on this aspect of the DeepWater Horizon Settlement Structure.

Seafood Compensation Program (You have 30 Days)

Under the terms of the BP Settlement, people that are taking part of the Seafood Compensation Program only have 30 Days after the Judges approval to present their claim to the DeepWater Horizon Settlement Fund for Approval. That means the clock is ticking and if you haven`t filed yet, you need to.

BP Settlement Numbers

91,000 people had so far filed with DeepWater Horizon Settlement Fund. They expect that number to hit over 1,000,000, hopefully many more will come to the table now that the Judge has formally approved the BP Settlement.

Excluded Claims Have Until January 19th to be Presented to OPA

For all of its flaws, and it still has a few, in this writers opinion it is a whole lot better then what the GCCF was under Mr. Feinberg. It is transparent, it has a clear methodology, and it is not arbitrary. The folks that run the DeepWater Horizon Settlement want to pay you, and many claims that were shunned by the GCCF are welcomed under the terms of the BP Settlement.

Multiple Store Locations

We have seen a tremendous growth in Companies with multiple stores, in multiple locations, making BP Settlement Claims with us as of late. Recently, we got an Appeal from BP for one of our clients claims.  That`s right BP appealed a Settlement Claim that was originally approved by the Settlement Fund. Needles to say our client was not happy, and nor were we.

We went through the process on the behalf of the client, it was arduous, but in the end we prevailed. I am very proud of our Team and the efforts they made on behalf of this client.

Banner Week for Getting BP Settlement Claims Paid.

deepwater horizon settlement  Last week was a big week for getting claims paid for us, we had over 15 BP Claims paid. This has been a long time coming, but well worth the wait. The claims ranged from Business Claims in the Keys to VOO Claims in Florida, Alabama, Louisiana, and Mississippi; they came in from a few months to a few weeks ago. It seems the people that are running the DeepWater Horizon Settlement are getting into a higher gear.

Attorneys are gearing up for OPA Presentment

We are hearing that many attorneys are not taking any new claims in at this time because they are devoting their assets/people to OPA presentment. Claims that are being presented to OPA, (opt out claims and excluded claims), must be presented by January 20th, 2013.

This basically means it is crunch time for the firms that have caseloads of OPA claims that need to be re-presented and recalculated. If you have a claim that meets this criteria they need to be addressed sooner then later.

Old GCCF Claims

What many people do not realize, is that claims under the old GCCF need to be updated to fit into the Settlement.  If you have a claim that has yet to be updated we will see what we can do to help you. There are hundreds of thousands of claims that still need to be updated.

BP Business Claims

BP Property Claims and VOO Claims get first look

bp property claims  The DeepWater Horizon Settlement Fund has certainly made a priority of paying VOO Claims and property Claims first. With over 3,300 Notices sent out, over 3,150 are either for BP Property Claims or for VOO Charter Payment.

VOO Charter payment accounted for over 2,500 Eligibility Notices for Payment. We told you VOO Claims would be the first to get paid months ago. We have gotten VOO Claims processed and paid in under a week.

BP Claims Status Report

On September 5th the Claim Administrator Pat Juneau , made available a report on the progress and the status of the claims review process. There are serious issues that they are encountering, they are trying to develop workarounds to these issues.

BP did not seem to be amendable regarding some of the workarounds. Shortly after the report the Department of Justice came out with a statement that they would be pursuing Gross Negligence charges against BP. A few days after that The Settlement Fund came out with a notice that some document requirements would be relaxed. Hopefully BP got the message, and this will allow for more claims to be paid, and faster processing.

According to the Report many claims did not have sufficient documentation.

  • 40% are missing one or more required documents
  • 52% of Represented and pro se Claimants Claims were incomplete
  • 48% of the claimants had claims with the GCCF that were incomplete
  • 8,100 claims have been reviewed since mid-July

The numbers of Business Claims, Seafood Compensation Claims, and Individual Loss economic claims that have received an eligibility notice for payment is tragically low. This will hopefully change as the documentation guidelines have been relaxed. They needed to be.

This what we have seen through our network, VOO Claims are getting paid, many of the VOO Claims we have gotten paid had already taken Quick Pays.

Many of our larger Business Claims and those in our Network, have Claims that have gone under review. Several firms in the Network have received offers for their Business Claims, most of these offers were accepted and considered to be fair.

BP Settlement Fund has much to Do

The report went on to say that The Settlement is trying to get out letters of determination to over 30% of the Claimants by October 1. We had been told they were attempting to do this by September 10th.

We have been recently told  they will be sending out letters of determination to over 3,000 by the end of the week, with approximately 1/3 of them receiving offers, in essence by October 1, over 15,000 people should know exactly where they stand.

Time is running out for the BP Settlement, I do believe the people in leadership positions have the best intentions. I also believe that they are running head long into obstructions that have been there since the GCCF, and if these obstructions are not removed very shortly the settlement may not survive.

If BP does not play ball and actually try to move the process forward, instead of hiding behind their lawyers and legal wrangling, there will be serious ramifications, whether it is through a Massive Boycott, the D.O.J, or some other mechanism. I guarantee to you, it won`t be pretty.

The BP Oil Spill was their fault not Ours. We need to hold them accountable, and We will.

Issues that need to be Addressed

Some real areas of concern right now are revolving around the environment, Oysters in Apalachicola and the surrounding areas are not spawning. We all know that Corexit is to blame, I was told BP was trying to blame it on past storms. My suggestion to BP is to take FULL responsibility for ALL of the Environmental after shocks of this Disaster.

Medical issues are continuing to worsen for many. People that were on the front lines are dying from very aggressive cancers. The National Institute of Health that has been taking samples for months,  are sending out very vague letters staying very clear of linking the Oil Spill or the use of Corexit to these peoples health issues. People are dying here, we need real answers, not rhetoric.

Quick Pays, one thing I have learned form many of the people that make a living from the Gulf is that many of you have have issues reading, and many of you took Quick Pays. There is not one doubt in my mind that you were preyed upon, this issue needs to be fixed, and fixed now. With all of the issues the fisheries are having and the catches dwindling as they have, people are getting very desperate out there, and something needs to be done for them.

Voo Claim Paid in 19 Days and BP Settlement News

We are getting BP Claims Paid

bp settlement  The VOO Claim came in August 1st and was immediately processed and presented to the DeepWater Horizon Settlement Fund August 8th.

An offer was received on August 27th, the claimant accepted the offer.

The Claimant was notified that all of his economic claims would then be handled under the terms of the DeepWater Horizon Settlement and agreed to that. The claim was handled for a 15% contingency fee.

There were several other BP Claims paid by our groups, they included Business Claims and more VOO Claims.

BP Settlement Calculations Dead On

The processing center that handles the majority of our large loss claims figured a BP Claim for approximately $359,540.00 the offer was for $359,410.00 they were off by $130.00.

We are thrilled with the accuracy of their calculations, this group also only charges 15% and only gets paid when the client gets paid.

Franklin County and Apalachicola Oystermen need Help

The more I have been hearing from Oystermen in Apalachicola, the more concerned I am for their future welfare.

It seems as though there is no new growth on the Winter Bars where they harvest Oysters.

The September 1 Oyster Season is right around the corner, Franklin County Commissioners are looking for help from BP and the EPA immediately.

The dispersant Corexit is most likely to blame, it has also caused a spike in Heart Attacks and Strokes in the Oystermen and Women`s communities.

This needs to be addressed immediately, members of the National Institute of Health have been taking hair and nail samples for months, enough sampling already, get these folks and others help now, people need to be made aware of the effects of Corexit.

Hurricane Isaac Stirs up the Gulf and Bays

Hurricane Isaac has pummeled Louisiana, Alabama, Florida, and Mississippi, Oil from the BP Spill will be hitting the shores of Our Beaches. Submerged Oil Mats known as SOM`s will be breaking apart and relocating. These mats still consist of 17% crude oil.

If you see Oil on the Beaches or in the Bays we want to hear about it, and take pictures if you can.

October 1 Opt Out Date Extended to November 1

BP Settlement News from the Gulf:     Shrimpers Stories

We have been hearing recently from shrimpers that are coming back in from the Gulf of Mexico and the Bays about the Health of the Gulf, the news is not good. Shrimp catches are down, way down. They are picking oil up in their nets more often then not. The shrimp and killfish they are finding in their nets have lesions, they are missing eye sockets, and they have a myriad of other issues.

The FDA says it`s fine to eat, we all know better. We have been told by numerous sources they just raised the testing levels of what is acceptable. The Shrimpers themselves have never seen anything like this in generations.

They are being forced to shrimp because many had taken Quick Pays, and it is the only hope of putting food on the table this year. The collapse of the Northern Gulf `s Seafood Industry can not be denied. If the BP Settlement does not address these issues, they in essence are forcing people to fish and exposing all of us to these deadly catches.

If you took a Quick Pay or a final, you can still be a part of the VOO Settlement Class and the Medical Settlement Class under the BP Settlement. Many of you are sick but are attributing the High Blood Pressure to Stress and other factors. If you worked in the water or around the water during the Spring, Summer and Fall of 2010, odds are you are sick from the dispersant corexit and the oil.

There are tests that can help show this, one is called a Volatile Organic Compound Test, it measures the heavy metals in your body. If you are a fishermen, shrimper, crabber, and especially oystermen and clammer`s you need to go see a doctor.

We are hearing far to often of strokes and heart attacks, and are seeing a trend that is alarming. Many of you have not connected dots here. The BP Settlement can help you monetarily speaking, but you need to take the initiative when it comes to your health. The National Institute of Health is in the region taking hair, nail clippings and blood samples, they wouldn`t be there if it wasn`t serious.

The BP Settlement can only address so much, but the door is open if you took a Quick Pay to be a part of the BP Settlement for Medical and VOO Claims.

The BP Settlement and some random Thoughts

You can not ask a man or a woman not to put food on the table for their families, if given the option of catching some tainted seafood, or their families starving, the choice is quite easy.

The BP Settlement needs to be proactive in its approach to paying people, especially paying those on the front lines. The BP Settlement should recognize the businesses that exist because of the Fishermen, Crabbers, Shrimpers and Oystermen, seafood processors and other assorted upstream businesses should receive higher multipliers if they choose to be a part of the BP Settlement.

Many of you are entitled to multiple claims under the BP Settlement. Lets take for example a Fishermen that worked on the VOO Program who lives on the water.

This is conjecture until the Settlement is announced, but educated conjecture.

bp settlement voo claimsAs you may have heard, the BP Settlement was filed today, 4/16/12, with the Eastern District Court. The court will meet with the parties, the Plaintiff Steering Committee and BP, et al., on May 3rd.

The meeting will be to hear objections, hear the applicable laws applied to the Settlement Agreement, then, hopefully, make FINAL modifications. We will keep you posted to the details.

As for BP Settlement VOO Claims, there are a few things you should know now. You should know who qualifies and the methods to calculate your awards for BP Settlement VOO claims.

 BP Settlement VOO Claims Class

The class created for BP Settlement VOO claims will include the owners of the vessels used in the VOO program, the boat captains and crew members of those vessels and the ones who were contracted to start working, but did not work.

In other words, to make a BP Settlement VOO claim, you had to have a signed the Vessels of Opportunity Charter Agreement. In addition to the VOO Agreement, you must have the VOO training, IN ADDITION TO the Agreement, in order to qualify for payment. If you were a deckhand on a VOO vessel, you need pay stubs or employer letters that verified you as an employee on board the VOO vessel.

If you meet the above criteria for the BP Settlement VOO claims, you will be able to be compensated based on the amount you worked. BP Settlement VOO claims will be awarded a percentage.

The more a VOO operator worked, the less that operator will get paid. BP Settlement VOO claims made up of a VOO operator, or deckhand, who was put on the waiting list, will be able to receive an award equal to market charter rates for a set number of days.

BP Settlement VOO claims made up of a VOO operator that worked in the program, will be able to get an award for the same market charter rate, but for less days, because they actually worked. The word is if you were out on VOO and worked 1 day you will get paid for 26 days but, we are still waiting to hear exactly what the BP Settlement mandates.

Keep in mind, that BP Settlement VOO claims will be made up of a large grouping of commercial fishermen and crabbers. If you happen to be a class member in the BP Settlement VOO claims, you may also file for a BP Settlement economic loss claims.
